Student Guidelines

The Student Discipline Instructions issued by the Ministry of Higher Education and Scientific Research in Iraq, Instruction No. 160 of 2007, as amended by Instruction No. 169 of 2018:

Article 1
The student must adhere to the following:

Comply with the laws, regulations, internal rules, instructions, and orders issued by the Ministry of Higher Education and Scientific Research and its institutions (university, commission, college, institute).

Avoid offending religious beliefs, national unity, or ethnic sentiments, and refrain from inciting sectarian, racial, or religious strife through words or actions.

Do not harm the reputation of the ministry or its institutions through words or actions, whether inside or outside.

Maintain high university discipline, respect the administration, faculty members, employees, and foster collegial relationships and cooperation among students.

Exhibit disciplined behavior that positively impacts future employment, scholarships, and academic fellowships.

Refrain from any actions that disturb order, tranquility, and peace within the university campus (college or institute), including participation, incitement, or concealment of perpetrators.

Preserve educational materials and university property.

Ensure the smooth progress of studies and maintain the discipline required for lectures, seminars, and activities held within the university campus.

Adhere to the prescribed uniform while considering the specific requirements of each university or commission.

Avoid promoting organizations that deepen divisions or engage in political, religious, or social persecution.

Refrain from promoting any political party, organization, ethnic, national, or sectarian group through posters, banners, or seminars.

Do not invite political figures to deliver lectures or hold political or religious propaganda seminars within the university campus to preserve national unity.

Avoid using mobile phones, personal computers, or other devices in a manner that disrupts collegial relationships and public morals within the university campus.

Do not attend college or institute under the influence of alcohol or drugs.

Article 2
A student shall be warned if they commit any of the following violations:

Failure to adhere to the prescribed uniform.

Disrupting collegial relationships or verbally offending another student.

Article 3
A student shall be warned if they commit any of the following violations:

Any act warranting a warning after previously receiving a warning.

Disturbing order, tranquility, and peace within the university, commission, college, or institute.

Article 4
A student shall be suspended for 30 days if they commit any of the following violations:

Any act warranting a reprimand after previously receiving a reprimand.

Verbally offending a university staff member who is not a faculty member.

Defaming a faculty member in a manner that harms them inside or outside the college or institute.

Posting materials within the university campus that violate public order and morals.

Article 5
A student shall be temporarily suspended for up to one academic year if they commit any of the following violations:

Repeating any of the violations listed in Article 4.

Engaging in or inciting sectarian, racial, political, or partisan gatherings within the university campus.

Physically assaulting a university staff member who is not a faculty member.

Using violence against fellow students, threatening them, or attempting to blackmail them using images, recordings, or other means.

Threatening to commit armed violence.

Carrying weapons, whether licensed or unlicensed, or possessing harmful tools or substances within the university campus.

Deliberately or negligently causing damage to university property.

Offending national unity or religious beliefs.

Verbally offending a faculty member inside or outside the college or institute.

Damaging the reputation of the university or commission through words or actions.

Deliberately disrupting the smooth progress of studies.

Committing fraud or deception against fellow students or university staff.

Article 6
A student shall be permanently expelled from the college or institute by a decision of the university council if they commit any of the following violations:

Repeating any of the violations listed in Article 5.

Physically assaulting a faculty member or lecturer.

Engaging in disgraceful acts that violate morals and public decency.

Submitting forged documents or being involved in forgery.

Committing acts that disturb security and peace within the university campus.

Being convicted of a felony or a dishonorable misdemeanor with a sentence exceeding one year.

Article 7
The disciplinary penalties listed in Articles 2, 3, 4, 5, and 6 do not exempt the student from additional legal penalties if the violation falls under criminal laws.

If a criminal case is filed against a student for an act committed outside the university campus, disciplinary action shall be postponed until a final court ruling is issued.

Article 8
The Dean of the College or Institute shall form a Student Discipline Committee, chaired by the Assistant Dean and comprising two faculty members, one of whom must be a legal expert. An administrative staff member shall serve as the committee secretary.

The Dean may appoint a legal faculty member from outside the college or institute to serve on the committee.

If the committee determines that the student's act constitutes a crime under criminal laws, it shall recommend referring the case to the competent court.

Article 9
No disciplinary penalty shall be imposed unless recommended by the Student Discipline Committee.

Article 10
Disciplinary penalties shall be imposed by a decision of the College or Institute Council, which may delegate its authority to the Dean.

Article 11
A student expelled from the college or institute may appeal the decision before the Administrative Judiciary Court.

Suspension periods shall not be counted as part of the absence periods stipulated in Article 9 of Examination Instructions No. 134 of 2000.

Article 12
This article was deleted under Amendment No. 169 of 2018.

Article 13
The disciplinary decision shall be posted on the college or institute notice board for at least 15 days and shall be officially communicated to the student's guardian.

Article 14
The Student Discipline Instructions No. 19 of 1989 are revoked.

Article 15
These instructions shall be effective from the date of publication in the official gazette.
